1. Acceptance of Terms

By accessing or using the BackQ platform at backq.io (the "Service"), you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, you may not use the Service. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

BackQ provides an application maintenance and ticket management platform that enables organizations to manage support tickets, track projects, collaborate with team members, and maintain software applications. The Service includes web-based tools for ticket management, project tracking, team collaboration, reporting, and related features.

3. Account Registration

  • You must provide accurate and complete registration information
  • You are responsible for maintaining the confidentiality of your account credentials
  • You are responsible for all activities that occur under your account
  • You must notify us immediately of any unauthorized use of your account
  • You must be at least 16 years old to create an account

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of any applicable laws
  • Upload or transmit viruses, malware, or other malicious code
  • Attempt to gain unauthorized access to the Service or other users' accounts
  • Interfere with or disrupt the integrity or performance of the Service
  • Use the Service to send spam or unsolicited communications
  • Reverse engineer, decompile, or disassemble any part of the Service
  • Use automated tools to scrape or collect data from the Service without permission
  • Impersonate another person or entity

5. Intellectual Property

The Service, including its design, features, and content (excluding user-generated content), is owned by BackQ and protected by intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms.

6. User Content

You retain ownership of content you submit to the Service (tickets, comments, attachments, etc.). By submitting content, you grant BackQ a non-exclusive, worldwide license to use, store, and process that content solely for the purpose of providing the Service.

You are responsible for ensuring that your content does not violate any third-party rights or applicable laws. We reserve the right to remove content that violates these Terms.

7. Workspaces and Teams

  • Workspace administrators are responsible for managing access and permissions within their workspace
  • Workspace data is isolated from other workspaces
  • The workspace owner is responsible for ensuring compliance with these Terms by all workspace members
  • Upon deletion of a workspace, all associated data will be permanently removed within 30 days

8. Subscription and Payment

  • Some features of the Service require a paid subscription
  • Subscription fees are billed in advance on a monthly or annual basis
  • All fees are non-refundable unless otherwise stated or required by law
  • We reserve the right to change pricing with 30 days' notice
  • Failure to pay may result in suspension or termination of your account

9. Service Availability

We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will make reasonable efforts to notify users of planned downtime in advance.

10. Data Protection

We handle your data in accordance with our Privacy Policy. We implement appropriate technical and organizational measures to protect your data. You are responsible for maintaining backups of any critical data you store on the Service.

11. Limitation of Liability

To the maximum extent permitted by law, BackQ shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or business opportunities arising from your use of the Service. Our total liability for any claims shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold BackQ harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your content, or your violation of these Terms.

13. Termination

Either party may terminate the agreement at any time. You may stop using the Service and delete your account. We may suspend or terminate your access if you violate these Terms or for any other reason with reasonable notice.

Upon termination, your right to use the Service ceases immediately. We may retain certain data as required by law or for legitimate business purposes.

14. Modifications to Terms

We may modify these Terms at any time. Material changes will be communicated through the Service or via email at least 30 days before they take effect. Your continued use of the Service after changes take effect constitutes acceptance of the modified Terms.

15. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Kingdom of Thailand, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Thailand.
